Welcome to Payge. These Terms & Conditions ("Terms") govern your access to and use of the Payge platform available at payge.store, including our website, merchant dashboard, AI storefront builder, subdomain and custom domain hosting, payment integrations, and all related services (collectively, the "Platform").
By creating an account, using the Platform, or operating a store on Payge, you agree to these Terms. If you do not agree, please do not use the Platform.
1. About Payge
Payge is an AI-powered e-commerce platform that enables creators, entrepreneurs, and businesses to create online storefronts, list products, accept payments, manage orders, run marketing campaigns, and track analytics — without requiring technical or design expertise.
2. Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use Payge. By using the Platform, you represent that you meet these requirements and that all information you provide is accurate and complete.
3. Account Registration
- You may register using Google OAuth or other methods we provide. You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at mishraanmol258@gmail.com if you suspect unauthorized access to your account.
- We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.
4. Merchant Stores and Content
As a merchant on Payge, you may create stores, upload product images and descriptions, customize themes, configure domains, and sell products or services to your customers.
- You retain ownership of content you upload, but grant Payge a non-exclusive, worldwide license to host, display, and process your content solely to operate the Platform.
- You are solely responsible for the accuracy, legality, and quality of your products, pricing, descriptions, and customer communications.
- You must not sell prohibited, illegal, counterfeit, or restricted items as defined by applicable law and payment partner policies (including Razorpay's acceptable use guidelines).
- AI-generated content provided by Payge is a starting point. You are responsible for reviewing and approving all content before publishing.
5. Payments and Fees
Payge integrates with third-party payment gateways, including Razorpay, to enable merchants to accept payments from customers.
- Payment processing is subject to the terms and policies of the respective payment gateway. Payge is not a bank or licensed payment institution.
- Merchants are responsible for setting their own product prices, taxes, shipping charges, and refund policies displayed on their storefronts.
- Payment gateway fees, transaction charges, and any applicable Platform fees (if introduced) will be disclosed to merchants before they are charged.
- Payge is not responsible for payment failures, chargebacks, or disputes between merchants and their customers, though we may assist where reasonably possible.
- Merchants must comply with all applicable tax, GST, and financial reporting obligations in their jurisdiction.
6. Refunds and Cancellations
Refund and cancellation policies for products sold through merchant storefronts are set by individual merchants. Payge does not guarantee refunds for purchases made on third-party merchant stores unless explicitly stated otherwise.
If you are a merchant, you must clearly communicate your refund, return, and cancellation policy to your customers on your storefront. Payge provides policy page templates for this purpose.
7. Subdomains and Custom Domains
- Payge provides platform subdomains (e.g.,
yourstore.payge.store) as part of the service. - Custom domain connection is subject to successful DNS verification and third-party hosting provider availability.
- We reserve the right to reclaim, restrict, or disable subdomains that violate these Terms, infringe intellectual property, or are used for abusive purposes.
8. Acceptable Use
You agree not to:
- Use the Platform for any unlawful, fraudulent, or harmful purpose
- Upload malware, spam, or content that violates third-party rights
- Attempt to gain unauthorized access to Payge systems or other user accounts
- Reverse engineer, scrape, or overload the Platform infrastructure
- Misrepresent your identity, products, or business
- Use the Platform to process transactions for prohibited goods or services
- Interfere with the proper functioning of other merchants' stores
9. Intellectual Property
The Payge name, logo, platform design, software, and all related intellectual property are owned by Payge and protected by applicable laws. You may not copy, modify, or distribute any part of the Platform without our prior written consent.
If you believe content on the Platform infringes your intellectual property rights, contact us at mishraanmol258@gmail.com with details of the alleged infringement.
10. Third-Party Services
The Platform relies on third-party services including Firebase, Razorpay, Vercel, Google Analytics, and AI providers. Your use of these services may be subject to their separate terms. Payge is not liable for actions, outages, or policies of third-party providers.
11. Service Availability
We strive to keep Payge available and reliable, but we do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue features with reasonable notice where possible. Scheduled maintenance and unforeseen downtime may occur.
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYGE AND ITS FOUNDERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE PLATFORM.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF PAYGE SHALL NOT EXCEED THE AMOUNT YOU PAID TO PAYGE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR INR 5,000, WHICHEVER IS GREATER.
14. Indemnification
You agree to indemnify and hold harmless Payge from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your store content, your products, your violation of these Terms, or your violation of any third-party rights or applicable law.
15. Termination
You may stop using Payge at any time. We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or if required by law or payment partners. Upon termination, your right to use the Platform ceases, though provisions that by nature should survive (including liability limitations and indemnification) will remain in effect.
16. Governing Law and Disputes
These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in India, unless otherwise required by mandatory applicable law.
17. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of Payge after changes constitutes acceptance of the updated Terms.
